Terms of Service

These terms are the agreement between you and ClipBuffer ("we" or "us") for the ClipBuffer website, desktop apps, iPhone app, Discord bot and clip server (together, "the service"). By signing in or using any part of the service you agree to them.

1. What ClipBuffer is

ClipBuffer keeps a short rolling buffer of live streams on Kick and Twitch and cuts clips from it the moment you ask. The desktop app buffers on your own computer; the clip server (ClipBuffer Cloud) buffers the channels you add on our servers, keeps only the last few minutes of each stream, and keeps the clips you cut for a limited period, currently about a week.

2. Your account

You sign in with Discord, and your Discord account is your ClipBuffer account; you are responsible for everything done through it, so keep your Discord login secure. An account is for one person: sharing it, or the session tokens the apps use, is not allowed. You must be at least 13 years old.

3. Plans, trial and credits

• Subscriptions. A subscription is a 30-day period of access; paying again adds 30 days to whatever time you have left. Nothing renews automatically.
• Prices. The Regular plan and the Prestige member plan cost what the website shows when you pay. Prestige pricing, and any period in which membership itself grants access, depends on being a member of The Prestige Discord server, which we check automatically at sign-in, at checkout and from time to time afterwards. Leaving the server ends Prestige pricing and any access that came only from it. Price changes never shorten time already paid for.
• Free trial. Each account can start one free trial of 24 hours. It cannot be started again, even through a second account made by the same person.
• Clip credits. Without a plan you can buy clip credits; the clip server spends one per clip it cuts for you. Credits never expire, are not used while a plan is active, have no cash value, and cannot be transferred or refunded.
• Complimentary access. We may comp, extend or add credits to an account at our discretion, and may withdraw it at any time.

4. Payments

Payments are made in cryptocurrency through OxaPay, a third-party processor, from your own wallet; we never see or hold your wallet keys, and any fee shown at checkout is paid by you. If your access has not unlocked a few minutes after a confirmed payment, or you paid after the payment link expired, tell us on Discord and we will match the payment by hand. Because cryptocurrency transfers cannot be reversed, all payments are final and not refundable once confirmed, except where the law requires otherwise.

5. Acceptable use

You agree not to:

• harass, threaten, stalk or defame anyone with the service or with clips made with it, or clip people who have asked not to be clipped;
• clip or publish content in ways that break the law, including copyright and privacy law, or the rules of the platform it came from;
• resell, rent, sublicense or share access, sessions or clip credits, or run a clipping service for others on top of ClipBuffer;
• attack, overload, scrape or probe the service, bypass payment or licence checks, or interfere with other people's use;
• upload a watermark image you have no right to use, or that is illegal or hateful.

We may suspend or revoke an account that breaks these rules, without a refund.

6. Streams and other people's rights

The streams you clip belong to the streamers and the platforms that carry them; ClipBuffer is a tool and gives you no rights in that content. You are responsible for complying with Kick's and Twitch's terms of service and with the rights of the streamers and anyone else who appears in what you clip, wherever you post it. We may stop buffering a channel or remove clips at a streamer's or platform's request, or where we believe we need to.

7. Your content and our software

You keep whatever rights you have in your clips and watermark image, and allow us to store, process and deliver them as needed to run the service; we use them for nothing else. We grant you a personal, non-transferable licence to run the ClipBuffer apps while your account is in good standing. The apps update themselves, and the iPhone app is distributed through Apple's TestFlight under Apple's terms as well. You may not copy, modify, redistribute or sell the apps.

8. Availability

The service depends on Kick, Twitch, Discord, OxaPay, Apple and our hosting providers, none of which we control, so we do not promise that it will be uninterrupted or error-free, that any stream can be buffered, or that any clip can be cut. We may change, suspend or discontinue any part of it.

9. Ending access

You can stop at any time and can ask us on Discord to delete your account. We may suspend or end your access if you break these terms, do not pay, or if the law requires it; ending access for breaking the rules brings no refund. The sections that protect other people and limit our liability keep applying afterwards.

10. No warranty and limited liability

To the fullest extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement; you use it at your own risk. To the same extent, ClipBuffer and the people who run it are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, clips or opportunities, even if we were told they were possible, and our total liability for all claims together is limited to what you paid us in the 12 months before the claim. Some places do not allow some of these limits, so some may not apply to you.

11. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict of law rules, and disputes will be heard in the state or federal courts in Pennsylvania, unless the law where you live lets you bring a claim at home.

12. Changes to these terms

We may change these terms; the new version is posted here with a new "Last updated" date, and significant changes are also announced on the website or Discord. Continuing to use the service after a change means you accept it.
